Is it the same goverment?  Yes? Then it is perfectly capable of repeating 
past errors.  The beauty of the US goverment is NOT that it is perfect but 
that it doesn't lose the ability to return to status quo ante.  The US 
goverment Royally screws up, on a yearly basis. But we get over it. 
Unconstitutional laws eventually get repealed.  Not before they do 
irreversable damage, but they do get repealed eventually.  Because they 
goverment DOES screw up, it does not deserve the powers you describe.

It is interesting the language of that last sentence.  You seem to be 
implying that sex offenders are not actual criminals.
