There is no indication at all, in EoE, that any distinction is made between the ultimate fate of those who died immediately before TI, and those, like Maya and the others, who lost their physical form while alive and conscious. As for the question of how long somone can be dead before their soul is 'irretreivable' by Rei and TI, that is an ambiguous, basically unanswerable point; I can only point out that Misato and Ritsuko were dead for only about ten minutes or so before TI, but they are certainly included, and, if you go by the TV ending, Kaji, who has been dead for pehaps a month before TI, seems to be around during Instrumentality (and his inclusion in this pic from ep26': http://homepage.mac.com/csf2860/Kissing_sux/evangelion025.jpg at the crucial moment that Shinji admits that "Still... I want to meet them again, because I believe my feelings at that time were real", seems to imply that he's eligible to come back too). Of course, you seem to be disregarding the rather crucial point that Asuka seemed to be just as 'dead' as Misato, and so, the fact that she comes back certainly does seem to me to settle, in the affirmative, the question of whether people who 'died' before TI can come back...
