Just an open question; no real right or wrong answer.
I actually had the opportunity to talk to a SONY record executive about
it once (he was an old friend of my boss, and SONY owns the rights.) He
said in that case, the company doesn't really have a policy, and if
you really were only downloading selected out-of-print stuff, at worst
you'd be contacted by the company's legal department and asked to pay
"fair market value" for the works (which is what I'd be willing to do
anyway.)
